I will be leaving for DC in a couple of hours. Need to pack, get gas tank full, and decide what clothes to iron and ton of other mundane things. Thanks a lot to all those people who participated in this 401K round. If you found these shots, guns and jokes etc. amusing, thank you for your support. If you think it was silly, I appreciate you, for keeping those thoughts private.
So here is my final shot for all the people who contributed for the first time, those who contributed again, to all those who were motivated, to all those who were amused and most of all to the people who are going to DC.
$100 Order Details - Sep 17, 2007 2:20 PM EDT Google Order #348908840140049
I usually dont share my private life. But just to let you know, I postponed my foot surgery on Friday so I can attend this rally. (First and last time on this thread to send some people on a teeny-weeny guilt trip). People under going heart surgery and people who tend to look at the roof (Ref. My previous post) are excused from this guilt trip.
Still a few shots left to be fired to finish this final round. You all know the reasons for taking those shots.
Adios. See you in DC.
P.S I will remove my signature after all the shots are fired.

1. Another reply was If we use All permitted unsed visa, Where would we be in terms of EB visa. His response was Probably china/India Second category will be clear.
2. According to Him 65% of visa has been used for this year. less amount of visa remain now for this year. We shouldn't expect miracle for this year at least.
3. Let Join hands together and follow the HSMP people did in UK.

One one hand you have folks who are getting labor approvals from BECs just now and have not filed I-140s.
On other hand you have PERM folks who have Labor, I-140 certified in 2 weeks.
Don't you think this provision is a bit harsh on those who've waited 3+ years for labor in BECs ?

I have to agree with SC3. PD porting from one EB category to another is a provision that falls within USCIS guidelines.
Yes, if an overwhelming number of applicants from a (more) retrogressed category port to a non (or less) retrogressed category, it 'hurts' some people.
I am EB2-I 2006 by the way, and this will hurt me as well. But I can't bash someone for utilizing to their advantage an option that is provided by the system.
And who am I kidding, if I was in their place, I would be doing the same thing.

I feel contribution campaign for a specific initiative will have a better result than a general contribution.
The home page should show all the initiatives that is being worked on. Who is leading the effort and then people can contribute for those efforts. This way everyone will have a say in what they feel is more important by contributing more to that effort.
The reason i feel this is because currently the only way i can understand the progress about any initiative is by constantly reading the forum. A lot of times people change topics and open several threads. I need to keep pace with the posts. I spend several hours a day to keep up. I may not be able to do this forever.
Legal employement based immigration has various aspects.Initiative are vast ranging from F1 visas to Advance Parole. If we break the contribution by initiatives, people can visit those areas so they can contribute their time and money more effectively.
Just my 2 cents.

Srikondo man,
I dont care your fight with 'buddyinus' or your friendship with 'frankzulu' and whether you were travelling by air/car/ship - I would like to ask you a SIMPLE question.
You started this thread saying that USCIS has a "deadline" for completing stuffs last Monday or last last Friday.... All of us trusted you that time - Could you please give us a responsible answer or status Update.
I hope you will reply this time.
Thanks,
Hello,
I think this is high time for us to control our emotions and live with realities. Often times, the customer service representatives don't have up-to-date information of USCIS's policies, decisions, and announcements, and we should not take their response as granted. For example, If you call a service center 5 times a day and ask a same question, you will get five different answers. In fact, Srikondoji mentioned what he had heard from NSC customer service staff. So, we can't blame either Srikondoji or customer service staff, but only USCIS.:)

Something just popped up from my family.
I filed concurrent 140-485-765-131 in Nebraska.
DHL delivered the package on 1st of february.
My checks were not yet cashed and I did not get any reply from USCIS (and neither did my lawyer).
My lawyer said it is impossible and I am better off refiling but this implies redoing a lot of things that cost money and time.
How can I try to expedite without a receipt number?

Believe it or not, I've met a taxi driver who graduated from an Ivy League institution and used to work at NASA in 60s and 70s and worked on developing algorithms for decompressing transmissions.
This actually reminds me of the joke:
A doctor's office got flooded. The plumber is called and he fixed the broken pipe in 5 minutes.
Doctor: "How much do I owe you?"
Plumber: "$200".
Doctor: "What! Even I do not make $200 for a 5 minute work!"
Plumber: "Which is why I changed profession."
:D

Here is the link to USCIS AC21 memo from 5/30/2008:
http://www.visalawyerblog.com/AC21%20MEMO%20JUNE%202008.pdf
it does say that H1B ext beyond 6 years can not be granted if there is not underlying pending process for GC (LC, 140 or 485).
However it does not talk about 'what happens if an ext is already granted'? so it still remains gray area. did I understand correctly?

I've sent 7001 to Ombudsman , Contacted Congressional offices and ultimately filed a Service request in Nov 1st week. After all this NSC opened my case yesterday Dec 9th and the status changed to "RFE sent" - there you go ! They bought at least 2 months extra time.
What a bunch of jokers at NSC - my case was extremely straight forward :(
Diptam,
Thanks for the updates.
My husband's I-140 is pending at TSC for an year now and employer is not agreeing to sign on form 7001. Can we send an e-mail to Omburdsman and expect some action to be taken?? does it help?

H1B petition can be revoked automatically if a) employer notifies USCIS that the petition is withdrawn or b) employer goes out of business. See 8 CFR 214.2.(b)(11). So yes, EAD is much safer in this regard. Revoked H1B petition cannot be used for transfer/extension. It's nice to have H1B as a fallback, but it's not a safe heaven.
Here is an interesting article regarding H1B and employer's obligation to notify the USCIS if employment ends.
http://www.chincurtis.com/pdfs/ccid_1_033007-1.pdf
Which means that EAD is much safer than H1b. Then why are Attorneys insisting on the opposite (H1b against EAD?)
If this is confirmed news, i will revisit my blog and make changes

During previous phone call campaigns, our members came out w/huge numbers and were instrumental in getting the support. This I know because the Senators office phones were just constantly busy and once you started mentioning high skilled, they would know and finish your statements for you. This time though, that does not seem to be the case. Please, please step up. I just called 4 out of TIER 1 again.

It is a letter by your I-485 attorney to USCIS mentioning your pending I-485 application (receipt numbers, filed where, including everyone part of the application), about your company securing I-140 approval under EB2 category for you and requesting to interfile this I-140 with pending I-485 and approval based on case is being current now (mentioning priority date). Copy of the I-140 approval notice (EB2) should be attached.
Some attorneys do attach I-485 receipt copies too. Also, your attorney may ask you to sign on the G-28 form that he/she is representing your case.

Do you mean to say, the employer just sends a letter with a signature and LIN numbers to revoke and USCIS revokes them?
In that case does USCIS send a confirmation of revocation of all the requested LIN numbers to be revoked? Or it is just a one-sided handshake?
Yes, I think it is just a letter.
Just like say, you do not want your Green card - you send a covering letter to USCIS and enclose the green cards. They shred the cards and process the letter update their records.
You can also send a letter to USCIS to withdraw your 485 - they will be happy to do so.
My dad had a expired green card (in the 70s) and recently when he went to consulate to get a toursit visa - he presented his expired green card (30+ years old) and they took him aside and completed some paperwork and took the expired green card and said they gonna process the return of expired green card - this is normal paperwork and procedure they follow.
What baffles me is - they follow all the laws perfectly - but when it comes to beneficiaries, we see all sorts of issues? I really do not think it is a training issue - this could be something else - maybe I am just speculating

Tina,
I had started a healthcare thread previously and it got poor response. Eventually we created an iv-physicians chapter to track our issues and work with the core team on the overall goals of ending retrogression.
There are a number of efforts on to help Schedule A applicants, some of these are parts of more comprehensive efforts like Cornyn's recent amendment.
I suggest you organize the Schedule A folks into a group. IV is very happy to work with any group that takes responsibility for their own needs.
See this blogspot we are creating to increase awareness of physician shortages and problems: http://iv-physicians.blogspot.com/
If you do form a group, try to expand it by bringing members in from outside iv as well- this would also expand iv's membership base.
I will be happy to help you with anything you need based on our experience with iv-physicians so far.
All the best!

Try your best to find a job. The market is picking up. At least try to join one of those desi companies even if they are offering a low salary. Just get past this time without making your situation a whole lot more complex.
Dont worry about lawyers, your ex employer revoking I140 - all that stuff doesn't matter now - just go find a job.
can they even withdraw 140 after more then a year now?
