On February 18 and 19, the University of California (Irvine) hosted a symposium where many of U.S. immigration's Rock-Star professors came together to try and solve "Persistent Puzzles in Immigration Law." I'm currently on H1B with a pending employment based I485 (EB3 category). I married my wife (USC) a year and an half ago and we decided to file a family based I1485 petition. We are currently preparing the forms and we have a few questions.
1. I485: Application Type Question: In my employment based I485, the option a. was selected for Application Type (An immigrant petition giving me an immediately available immigrant visa number that has been approved). What should we choose for this family based petition.
2. I765: (a) Applying For: When the company applied for employment based 485 few years ago, I got my EAD. I never used EAD as I always had my H1B. Hence, should I select "Permission to accept employment" or "Renewal of my permission to accept employment (attach previous employment authorization)"?
(b) Question 16: Eligibility under 8 CFR 274a.12 ( ) ( ) ( ). For my employment based application, it was (C) (9) ( ). What should it be for my family based application now?

Hi,
I have applied for COS from L1-B to L1-A and received an RFE which we have responded to.
The application is still pending with USCIS, while my I-94 is expiring on 07/31
What will happen if I do not receive decision before expiry of my I-94? Will I be out of status after the I-94 expiry date.
I have my I-485 pending as well (I-140 approved) and have EAD but not used.

This is not the appropriate forum to ask your question as most of us here are still waiting to get green card even after waiting upwards of 7 years. Some still have 5 or more years ahead of them barring immigration reforms.

My priority date will become current on June 1st 2011. I will add my wife to green card process on June 1st 2011 (she is in US in H-4 status now). My I-485 is with Texas processing Center.
If I leave my sponsoring (green card) employer after 3-4 months of getting my green card and join another employer or have my own company, does it affect my wife's green card that may be still in process

Hi,
I recently got 3 year extension on H1B. I am currently in 8th year of H1B extension. All previous stamping were done in India, I have following question regarding the Visa stamping in Toronto-
Can I get my stamping done in US consulate in Toronto.
Where (Link) to take an appointment for stamping.
List of the documents required.
Anyone who has done it before, Please help

Hi,
I am planning to apply for Alberta Nomination Program under NOC (Manufacturing and Industrial Engineers). Does anybody has any experience with this NOC. Also, I need to know how does this process work. I apply for ANP and when I need to move I apply for jobs and then I get work permit...right ? Then if I need to get a TN visa to come back to usa how do I do that. I have a house in chicago, so wondering if renting that out could be an option for me when I immigrate to alberta so that when I need I can come to chicago. I am in my 5th year of H1B and with the current scenario my present company is not going to start my GC (it stopped because of layoffs in the company).

My H1 stamping has expired. I have traveled using AP before. Just wanted to know if anyone traveled back with AP via Brussels?
Email I received from Belgium consulate just says "Indian nationals do not need transit visa". I am sure it means they do not bother about H1/AP as long as you have legal entry for the destination. Just wanted to re-check.

The answer depends on how far you have got in the permanent residence process. If the I-140 is approved and the 485 has been pending for 180 days, you can change employers if the new position is in the "same or similar occupational classification" as the one on the labor cert/I-140.

Hi All,
My OPT expires on March 20th 2012. According to USCIS rules, I am on valid F-1 status 2 months after OPT expiration. "nonimmigrant F�1 students on post-completion OPT maintain valid F�1 status until the expiration of the OPT period and the subsequent 60-day departure preparation period".
Is it possible for me to take advantage to cap-gap after expiration of OPT as I will still be on valid status? Can I quit work for 10 days after my OPT expiration and start working again on April 1st after a employer files my H-1?
Please advise.
