Eb2 people are highly qualified compared to EB3. I encourage EB2 people do the following before taking the action against eb3 to eb2.
1.Get more GC numbers.
2.Upgrade your self to EB1. So that you can get visas immediately.
3.Fight for GC approvals in FIFO order.
If you ignore above issues but focus on Eb3 to Eb2, you are definitely from EB2 and you want to fight for your own GC. Nothing else matters to you.

After the july fiasco, USCIS need not have to worry about recieving huge applications if they move the dates forward. Since almost all the folks (except for folks stuck at BEC) would have turned in the applications uscis should be able to move the dates forward for FY08 to a big extent , so that visa numbers are not wasted.

It is tricky. The intent can be proved only by how long the employee has worked for sponsor. If he/she worked considerable period (lets say for 2-3 years in non-immigrant visa (H.L,E) before filing 485 and worked for about 1 year after filing 485) then, it is very easy for the employee to prove his/her intent to have a permanent employment relationship with sponser, if employer try to revoke 140 based on the fact that employee does not have intent. The longivity of the employment relationship with sponser is a great proof. Some people are abusing (by misguidence of few lawyers, as they claim GC is for future job) AC21, without even working for single day with sponser, trying to get GC. USCIS may be controlling that kind of abuse.

The delay for approval of 485 in year 2000 is caused by USCIS poor customer service. Oh yeah...I've read that report. Dude just walk out if u dont like the process. Nobody is stopping u. Do u think things are faster in the country u came from? Its clearly an overflow which they cant handle. Before u give a red think twice. Read clearly what one is trying to say. I agree with IV's fight for speedening of the process. But to blame the USCIS and to ask for a change in management is too much. We have NO RIGHTS WHATSOEVER to ask for that.

1. We (the EB applicants) did not cross the border overnight. We were interviewed, shortlisted, H1B applicaion processed, approved and at the port of entry, we were welcomed by the officials. We did not sneak through.
2. Just because corruption prevails in India, it does not mean people can be treated badly here. Corruption in India is none of US business. We are here on business. US want our skills and we need the dollars. Period.
3. Beyond that, employers here (it could India or China based - but are established organizations here) see a requirement for our skills in future and US government is verifying that through LC and I140 and offering us GC. Now the fact that US immigration is broken is evident enough that this country is not error free. Every country has its own problems.
4. Let's talk about corruption. Where on earth is there no corruption? Whereever human beings are, there is corruption. 100%. It's here in the USA, its there in Japan, its there in Gulf. Everywhere. I am not saying corruption is good but is inevitable.
If you say, US thinks that because these guys are from India where corruption is to the core, and these guys have half the facilities (back home) that this country provide and hence deserve a broken immigration system that screws up their life, then my friend, this country is no better than any other country on this earth for being so mean. And, for that reason, if you ask me to get out of this country, I would like to say, humbly, that is none of your problem. If yes, ask every US organization that is trying to exploit the business potential in India to get out from India. When the last US business leaves India, I will leave this country.

Pappu, I agree what you are saying. But the bigger issue here is the awareness.. I talk to so many friends and friend's friend. The only thing that I find is they are not aware of IV or its effort.
Lack of awareness is another issue for IV community to form a lobby group like others.
IV has too many contacts in the media, would that not be a great idea to leverage them to advertise at prime time on Indian channels , or just the google ads on Dishnetwork screen for cheap or work out something.
Just to get the people an awareness of what IV is and get them a feeling that its BIG enough to help them. Support some candidates in the election, just to get the name floating. Leave aside the American, Indians or chinese(mostly the legal immigrants) I sometime work with don't know anything about IV. I go to SFO meet my parents almost every month and my brother's circle (all citizens) have no idea of what I am talking about. All they know there was problem is Labor clearance in their time which is no more now.
What is IV , who is IV........ no idea at all. NADA.
A planned campaign to make th awareness can help our cause.

After passing this bill politicians will cosy up and say good things to rebuild relations. The real impact can happen if Indians in New York state who can vote stand up against such laws. Same goes for the Desi companies who have tried to raise the voice against USCIS memo. They lack grassroots advocacy and support. Their Indian US citizen friends are busy organizing Diwali melas and Shahrukh Khan stage shows. Immigration voice can be extremely successful if politicians see us as an immigrant lobby. Just like they see Jewish lobby or Hispanic lobby. This is why participation of IV greencard members and citizen friends is important to advocate for changes that helps the immigrant community. I this case too, IV community should not turn a blind eye to what happens around us. Just because we do not work for such companies or we already have EAD does not mean we do not see beyond the headline of this issue. We spend more time analyzing , over analyzing, predicting and tracking rather than actively understanding the politics of issues that are causing all the problems we are facing. To some extent this law passed because Indians in USA did not care due to their narrow outlook and priorities in politics.
