Hi friends,
Today I had a LUD on my old I-129 (approved in Aug 2005). The online status say: �On August 29, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.�
I'm no more working for this employer and I�ve changed to a new employer a year ago. What does this status mean?Any ideas?
Does this cause any problem to my current GC process which was sponsored by current employer?

My sister, as part of submitting documents for her fiance visa application, recently got a birth certificate. However, it doesn't have her name on it. Odd as it sounds, the municipality says that this is common practice. It just has the name of the parents.
Is this acceptable for a fiance visa? Thanks.

My LC & 140 are approved under EB2 category. PD is Oct 2004. The same employer wants to promote and move me from New York to California.
The question is:
Can i file GC under PERM for the new role ( same company) in California. Assuming the PERM LC gets approved, can i port the PD of Oct 2004?
Any insights appreciated

Hi all,
I received an I-485 RFE for me and my spouse on July 28th. For the primary applicant it was Employment verification letter (currently dated letter from employer describing duties,position and salary info) and for my wife it was about proof of bonafide marriage.
My attorney replied to RFE on Aug 6th with necessary evidence and EVL.
Online status for both of us changed today Aug 10th from RFE SENT to RESPONSE TO RFE RECEIVED AND CASE PROCESSING RESUMED.
Hope this info is helpful in estimating time for people in similar situations.

I am really confused and I really need information about my situation.
I have graduated from Culinary Institute of America on June 18 and I had an application for OPT for July15. In normal process, I have received my OPT card and begin to work at the restaurant on July 15. However, because of an important family situation I have to go back to my country for one week between September 15- 22.
Now,my situation is; -I have an OPT card
-I have a job
-I am in my OPT year
BUT: on my OPT card, it says that, I can not leave the country during my OPT year
HOWEVER: I have to go back to my country for one week and there is no problem about taking off from my job.
I can not be sure about leaving the country,my question is: During the OPT period, IF you have a job and all your documents are done about OPT period, are you still should not leave the country? If you leave the USA, how can you come back?

My employer has been holding back my wages on some excuse or the other. Since I was awaiting my GC, I had no choice but co-operated with them. I got my GC last year in July 2010. I worked with them until September 2010 and due to this payment situation, I have chosen to work elsewhere.Now they promise to pay the back wages from 2010 but the payment never arrives. Repeated followups, emails and calls have yielded the same result. I am not sure what are my options here at this point. I no longer work for that Employer since they never pay on time.

Can we file I-485, after August 1 2007 and
before August 17 2007 (as I'm preparing my medicals).Is there a chance USCIS stop taking the application after July 31 2007 by giving some crap reason?Also I understand that filing fee is same for I-485 until August 17 2007.Is that true even for I-765 and I-131.Please clarify.

Can I e-file for AP?
What is the difference between Paper filigng and e-filing?.

Lou Dobbs said on Thursday he is considering career options including possible runs for the White House or U.S. Senate. I am on H1. I got married earlier this year :), my wife is on OPT which expires early next year. She is currently working for XYZ company which would not extend her OPT. We haven't been able to find a job(H1) for her yet.
Would any of below can cause any problem.
1. I don't have H1 stamping from my home country??
2. Her last name is not changed??
