(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....

In last week of June, my employer filed H1B visa via premium processing and it gets approved within a week. H1B start date is Dec 1, 2010.
Last week, I received RFE for my OPT application stating that my status has changed to H1B. Please provide approval receipt. I have sent the approval receipt to USCIS. Current online status of OPT application shows that USCIS office received requested documents and my case is pending.
1. Will it affect my OPT application?
2. My original joining date is already postponed by 2 weeks. Still I am waiting for OPT card. Should I request expedite processing of my OPT application? or should I wait?

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. If we want to find out whether USCIS will accept our applications, we have to prove that Visa #s were available on a particular day. This thread will track the 485 approvals received on or after June 28th.

My wife's EAD expires 10/10/08, she is currently on H4 but we filed last july and got our EAD/AP. I am planning to send her to india in May and she'll be back in November around 4th (AP expires Nov 19th).
Please help me with info on these questions?
1. Does she have to be in USA to apply for EAD renewal?
2. Can she apply for EAD renewal in May (5 months in advance), I know AP cant be applied before 4 months but dont know about this EAD.
3. Or Can EAD be applied after it expires also, if yes till howlong after it expires?
4. Also she'll come back on 4th Nov and applies for AP immediately, is this OK if she applies before expiry date of Nov 19th but doesn't get the approval? (I know that she cant travel until she has a visa in passport or AP again)

Pls. advise me on our best choice.
I am on H1 (primary), currently working for this company for past 6-7 years. Applied for I-485, AP, EAD on 2nd July along with my husband's petition, who came to US on H4. Changed to F1 for past 5 years. He just got his EAD card and in next 6 months time, he will be accepting position with my same company upon graduation.
My question is what shd we do now, since he is on F1 on student records, but has a EAD approved.
Possibilities :-
1) Shd he call his student dept and get records changed from F1 to EAD holder?
2) Shd he continue as F1 and not worry about EAD for now?
3) Shd he accept the pjob offer on EAD and move on from there?
4) Can I continue to be on H1 and not use up EAD for now?
Pls. advise me our further course of action, which is legally correct.
