Hi ,
I was in confusing situation,hope you can clarify and help me out.
My wife came to US as H4 in Feb 08.Her i-94 is valid till march 2010.
She applied H1 got H1 approved from Oct08 for 3 years.Since from Oct08 , employer couldnot find project for her.Her employer is asking to move from H1 to H4 back using Cos(i-539).After getting project can move back from H4 to H1 which doesnot come under quota.
My questions are:
1.Is it safe to move from H1 to H4 and back to H1 when she gets project.
2.Her previous H4 i-94 is valid till March 2010.She didnot went to india again.
If she converts from H1 to H4 now,till when she will get i-94(till my H1 valid or original i-94 date).
If she gets i-94 till original i-94 i.e March 2010,does she needs to go to stamping after March 2010 again or continue to be in US even after March or just go for border and get new i-94.
Can you please clarify.
Any suggesstions is really apprecaited.

My situation is not very urgent, but I like to stay on top of things. Thanks in advance for your help, it is much appreciated.
My F1 visa expires on July 6 of 2011. However, I have an I-20 that permits me to stay in the United States until August 31st of 2012. The reason for this is that I came here as a master's student, but transferred to a PhD program. This is my second I-20.
I have plans to leave for India in May of 2011 and stay until end June 2011. Will it be necessary for me to apply for an F1 Visa extension? Technically I'll be back by July 6, but will it be problematic to get back without a renewed visa because there are only a few days remaining on the old visa? Again, as per the I20 I can stay legally here until August 2012. Is it difficult to renew the F1 visa? All this is almost a year from now but I'm getting quite stressed about the situation. I cannot certainly finish my degree by July 2011.

Does the published cumulative demand data represent
a) all pending 485 cases that include primary applicants and their dependents
OR
b) all pending 485 cases that include primary applicants only?
If say, the demand data for EB3, till 2004 says 35,000 - does this mean there are a total of 35,000 pending cases in total OR does this represent primary applicants only?
If it represents primary applicants only, what is the multiplication factor we need to use to get an approximate number for total pending 485 cases?

I am also in the same situation that my company's attorney is not giving me I140 receipt number. They just say that it was filed in first week May but don't have the receipt number yet.

Hi,
I heard that if the filing of the 140 /labor /485 (any of them) have the filing date < 1 year at the end of the 6 year of h1b then I can not extend my H1B for the 7th year.
Questin: Is this correct?
Details:
Filled labor in june 2007.
Filled 140 /485 in aug 2007
6th year H1B completed in feb 2008.
Question: Am I eligible for the 7th year h1b extension?
If yes then for how many years of extenstion I get?
If not then please suggest what to do.
Note : I have not changed my employer since last 3 years.

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..
They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.
so should i come to new program..if thats the case how to get an emergency appoitment.

1. I'm AOS aplicant currently working with company X in US and planning to go to abroad and work for other employer Y for 1 year in abroad. Once I come back to US ,can i join with employer X on H1B and continue with GC processing?
If above can't be done
2. Assuming I withdraw my 485,so i will on H1B status. If H1B applicant currently working with company X in US and work for other employer Y for 1 year in abroad. Once I come back to US ,can i join with employer X on H1B and later continue with GC processing? - or H1B status abandon as soon as i change employment in Abroad
Please provide your suggestions
