Please help me understand this:
The Dept. of State's web site has the visa bulletin for SEpt 2008 as:
EB INDIA
--------------------
1st C
2nd 01AUG06
3rd U
And the US Consulate's web site at Mumbai has:
EB INDIA
------------
E1 Current
E2 1 April 2003
So, how come Consulates got the latest information? Why not post this on the DOS page too by the DOS?
I am so sick and tired of this whole process of GC. I am starting to question myself if this entire process of wait, is worth at all? If you are illegal, you are free in this country, if you are legal they scrutiny your papers with a microscope....I am sick, totally sick. There is a limit to patience, too.:mad::mad::mad:

Only on PD when the date is current
Not just priority date, but also receipt date.
My priority date has been current for a year now, but are they processing it? No, because my receipt date is 08/28/2006 and they are only doing 08/07/2006 now (after going back one month in Texas).

I have one question?
I have case id for ETA form. I could see my details by downloading MDB file from flcdatacenter. How can I know whether I am EB2 or EB3? I do not want to ask my employer.
Can somebody please answer?

OK here is a question.
Person working for past 4 years in the US.
Applied LC this February (2/26/07)
wants to go to canada and then reenter may be next year.
According to the new point based GC system--
1) Will the person get points for the 4 years of work in the US? (those 4 years were continuous, however, the person applies for GC after the canadian break of lets say 1 year)

I dont want another flurry of emails by explaining no-nonsense "conspiracy theory" behind all this (Hint - The day CIR failed , AILF came up with this 95%-98% truth in their websites and the day 2nd CIR resurrection attempt was being discussed is June 13th which is the July Bulletin release Date)
Our only option is to expose USCIS wrongdoings ( I mean all Kind of Wrongdoings ) via Media and at the end of the day show your GUTS to support AILA lawsuit by providing our real names etc... ( incase they need)
Nothing else is going to help.
We didn't do anything wrong , so lets fight for Justice.
They are not coming clean on this...first they said they used up 60K visas, now they are saying they worked over wkend to use 25K VISAS... Its a big scandal....Just to prevent us from filing...

No. Core member details are on IV About Us.
Agenda of lobbying remains same. It doesn't change weeky/monthly or even annually. Country quotas, increase in EB gc numbers, portability issues. It is also on IV website. Please look. No more details other than that will be made available, unless a bill is on the floor, thats when you see the results. Results are hard to come by. Core cannot reveal roadblocks or mini successes as these are all detrimental to the effort.
Are you part of core?

I wonder how i will convince some of my friends to contribute to an effort which is not shared?:confused:

But.. when AOS(485) is denied, won't the underlying 140 and for that matter labor is also denied?
Well once the h1b extension is granted - it is not retreated. It means that the person is in h1b status till the h1b expires (My understanding)
Now if 485 is denied when your h1b expiration's last day - then yes you are definitely out of all statuses
Such a thing is rare because person either files for h1b extension well before h1b expires or atleast decided he will use EAD
Issues will arise when h1b has to be extended and person is running out of time on existing h1b and the 140 revoke /485 denial happens (like say few weeks only because person was lazy to file h1b extension atleast 180 days before its expiry and decided to not use premium processing and h1b extension is pending)

Well....what happened was in line with what USCIS has done in the past..Last year they made the PD's current and then made it unavailable...this year they jumped the PD by 2.5 years and so the next thing was obviously to retrogress it back by 1 year behind the original date...
For the first time they have not surprised me !!!!!

We cannot start a S-corp on EAD. Need to be GC holder or US Citizen.
The Internal Revenue Code provides that a Corporation filed with any U.S. state shall be taxed under "Subchapter C." This essentially means that all Corporations start out as C-Corporations for tax purposes.
Should a Corporation's owners later wish to be taxed as an S-Corporation, they would file a "Subchapter S" federal tax election (Form 2553) within 75 days of incorporating or within 75 days of the beginning of the calendar year. To do this, the Corporation would need to have less than 100 owners, all of whom must be either U.S. Citizens or permanent resident aliens ("green card" holders). Once the "S" tax election is made, the return to be filed is the 1120 "S", rather than the 1120. Whether or not you decide to be taxed as an S-Corporation, your company is still a "General Corporation" in the eyes of the state of incorporation.

i have faced same problem in NC, we can't do anything unless we go out of country and get visa stamped in passport. rules have been changed in NC DMV since last year. i have visited 3-4 DMV's in NC, everyone told same thing.
My husbands DL expires on Oct 1st, 2007. The North Carolina DMV insists that he should have a valid H1B visa stamp in his PP in order to renew the license. He does have a valid H1B extension with I-94 at the bottom till Oct.2009. We dont want to leave the country as we are filing for our I-485's.
Any one in NC have any suggestions?

Beppen, I joined the conference a little late and heard of Sen. Brownback's amendments for extension of J1 visa rule and no cap for nurses/physical therapists in H1. They will reconvene at 2.00 again and present more amendments if there are any

Dear Jimi,
I am here in Los Angeles County in the city of Pasadena. It would be really nice if we could organize the So Cal Chapter and coordinate our " meet the lawmakers type meetings in the LA/San Diego area.
