On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. hi,
My h1 is approved in this years quota but i have not received I797. During this period if my h4 is stamped will my h1 be cancelled. or can i go to US on
h4 and then change my status to h1 ?

The consulate cannot approve you for permanent residence if there are no visa numbers available. Priority dates apply whether you do AOS or CP.

Friends,
I want to request everyone - Members and non member ( they will have to sign up at IV) to please update the all the information for the tracker.
Please update any communication that you may have had with USCIS, like RFE, Reciept notice and any other information.
This information can be very useful to IV for generating reports and talk to the officials confidently with data and looking at the trends .. say for RFEs or something else.
Anonymous users please sign in at IV using any ID , and update all the information related to any communication in the past with USCIS.
I would request everyone , that after updating the profile please post a comment to this thread , so that this floats on the home page for a couple of days, so that more and more users can read it and update their profiles

It would be very tough to get CP appointment before the end of July. So I am not even thinking of CP. Also CP needs to be approved when your PD is current.

my wife went to mumbai embassy. after intw they said they need some more info in their systems before issuing the visa. It was h1 renewing. But they didn't keep the passport. Told to submit the passport after they sent email or call you. They did sent the email to submit the passport within 2 days.

Hi,
I have an EB2 I-140 approved with priority date of July 2006, but also recently got EB3 I-140 approved with priority date of May 2003.
Even though the dates are current, but it may retrograte in coming months, so Can I file I-485 using my approved EB2 with the priority date of EB3.
Please advice.

My wife will be coming back in April 2nd week through Denver. CO POE. Her AP is valid until June 3rd week.
My question is that is 2 months of AP validity / cushion enough or safe to enter the US.
Will she get a 1 year I-94 validity from the date of entry or only until her AP expires?
This question has also been posted in the member forum and I have posted it here to get advice from the eminent lawyers from a legal standpoint.

I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?
Also what is considered my priority date since I havent/cant file an i-485 yet.

I work for company A in india which has a subsidary company "B" in US.
On "B"'s request i worked in US for company B from July 2006 to Nov 2006 (for which i have valid pay checks).
I went back to India and worked for A till June and i came to US again to work for Company B.
Now as soon as i entered US, i have applied for a premium H1 company transfer to Company C.
Now i got a query to submit my Pay checks which i do not have as i resigned Company B after coming to US.
Please suggest me whats the ideal way to answer this query...

My friend H1B is expiring this month end but she has valid EAD wth her.When we are planning to use EAD from H1B,what is the procedure for that?Do we have to send any forms to INS for this change of status??
Just you need to fillout a new I-9 form and hand over it (along with copy of EAD) to your H1B employer ,also mention moving to EAD..thats it..

Hello,
Please let me know if anybody is travelling from BLR(Bangalore) to BOS (Boston) by British Airways on Mar 1 2011.
Because my mother-in-law is visiting US and she is travelling alone. If some travel companion is there it will be helpful as she does't speak english.
