DHS' misrepresentations to communities regarding their ability to opt out of the controversial Secure Communities program has drawn the attention of Zoe Lofgren, the ranking Democrat onthe House Immigration Subcommittee. I got Duplicate I485, I765, I131 receipts. All the receipts has same A#. One set of I765 & I131 approved. For the second set , they send REF about Photos as I have not submitted any supporting documents ( Photos, I94 etc) for second set. I have submitted the second set as follow up since I didnt get receipts for the first set within 5 months.
Now I want to withdraw duplicate I485 set. Any problems ?

Hello,
I am in a pretty scary scenario...
My I-140 got denied based on inability to pay. My firm did send out the appeal to fight out the case. The appeal was sent 15 days back with the time limit stated in the denial letter. But today, I received the I-485 denial for both me (primary applicant) & my spouse (dependent).
I have H-1 as a back up but my spouse does not have H-4 status.
My Questions & concerned:
1) How long does it take INS to accept the appeal as I haven't seen any update on the same since the package has been delivered (15 days)?
2) What is next possible step for my spouse & how long can he stay in this country without applying for H-4?
3) If the appeal is accepted & the case gets into processing, will I-485 get back on track for processing & can my spouse start working on EAD?
Would appreciate any sought of guidance possible from the expert lawyers & the individuals with the similar experience & knowledge.
Time is very crucial & so immediate reply will be highly appreciated...

So this may be the last week of H1B visa filings, as of November 27, 2009, approximately 58,900 H-1B cap-subject petitions had been filed. USCIS has approved sufficient H-1B petitions for aliens with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petitions filed on behalf of an alien with an advanced degree will now count toward the general H-1B cap of 65,000. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

They can incorporate a company but they cannot do any work for it( not even write a check) or take any salary from it. But if the person has an EAD, there are very few restrictions.

Hello,
Need advise since I'm planning to get my H1 B stamped... On my 2nd visit on B1 Visa (Business) in 2005 I got an offer to complete my master's degree(sponsorship). I applied for a change of status and was approved. I completed my master's degree and filed for OPT which got approved and finally H1. I'm currently working for more than a year on H1 B visa. I was planning to get stamping done at Hyderabad, India.
Is it safe enough to get the visa stamped? And, do I need to take any additional documents to ensure that the visa gets stamped.... Please advise....

No, you only pay the visa application fees. India has a visa agreement with US so issuance fee is no longer required. You should check the US consulate website for more details.

The D40 requires an AF-S lens as far as I know, I have never actually used one. I know it will work wit the D70. I recommend trying it out before buying it if that is possible. It works on the D70 by setting everything to manual. Good luck
