On I140 form, notice type has information about INS section.
The INS section explain that your GC is under EB2 category or EB3 category.
INS section details
INA Section 203(b) (2) is EB-2
INA Section 203(b) (3) is EB-3

Will try to shorten the story.
I was with ABC consulting company and had applied for GC (and got perm and 140 approved). My contract with client ended. Though ABC were good but they could not get me a project so I had to shift to another company. I talked to ABC to get my GC proceeding with extra cost. They said (and attorney also) said my 485 has been filed. As the ABC had changed their name also, as notification for I-140. They also insisted to join back.
My new company layoff quite a lot of people. Needless to say, me also. Now my easy option is to join them back, but is there any possibility that to make me continue to work for them, they can do mess up in GC process?
May be question is quite personal, please suggest whatever cmes to your mind.

Hi,
Just wanted to get some feedback whether its possible to get i-140 approved using an old approved labor ?
- Case:EB3 ROW.
- The company A merged with B. (may be a successor-in-interst)
- Labor from B approved in 2005 w/pd=2005
- Labor from A approved in 2006 w/pd=2002.
- I-140 using 2005 LB approved with B
- Lawyer suggests to use the A's 2002 Labor to file a new i-140 under company B. He says that as per some law the old labor is still valid until end of this year. Please advice.

I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.
So I would like to know the options that I have to get my visa status changed to H1b.
1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?
2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?
Please kindly reply to my questions.

I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.
My uncle said that he will continuing the process of my GC application, under EB2 in his company A. When my employer looked up my case number on the DOL site, the case status showed as "certified" and apparently when he downloaded the certified ETA 9089 the section where it says "Signature of the certifying officer" doesn't bear CO's any stamping/signature.
My employer came to know this only yesterday obviously 'coz he overlooked and we just have two more months remaining on this PERM validity. My employer also said he can't file for I-140 unless we hear back from the DOL on the CO signature issue.
He has apparently emailed DOL asking for clarifction on this.
1. Would DOL even bother to look at the incoming emails after the case has been approved?.
2. Does CO's rubber stamp signature really required for 140?. What if we don't hear back from DOL on time, can we just go ahead with 140 filing?.
3. I am on my 6th year of H1b.
Any response on this matter is truly appreciated.

Hi All,
My EB3 RIR is filed on Feb 2005. Waiting for LC to clear. Also H1B expires on Jun 2007. Waiting for H1B extension for another 1 year.
I would like to change my job once I get my H1B extension.
1) Can I change my Job during my one year H1B extension when my LC is not cleared?
2) Can I use my current PD (Feb 2005) when my new Company process LC again through EB2 PERM?
3) From the new company, once I get LC through EB2 PERM, can I apply H1B extension for 3 years?
Please advice. Waiting for you reply.

Guys, applied recently for EAD and its pending and 180 days has not passed. I am planning to open a part time business. Does anyone know if its ok to start a part time business before the EAD gets approved ? Any insights will be appreciated.

If you draw salary as an employee of the business, it is a problem. Consult an immigration attorney. You cannot take up any work other than what is approved as part of your H1-B.

my wife is on her OPT and I am on my F1, her employer just filed for her H1b and my H4 I539 same time this week. (non profit university). So my question is do i need to go back to school next month to continue my education? or as long as the I539 is filed, i am under legal status? right now I have moved from Nebraska where we had our education to New york with my wife. if I have to go to school even when the I 539 is pending, can i just go transfer my status from the community college I am studying at in Nebraska to any community college that offers I-20 in New york? how can i report the change of school to USCIS after transfering? thanks!
