I just got my labor cleared. EB3.
I need to get the I140 processed
Any idea how much time it generally takes for this to process.
The reason I'm asking is because my h1 needs to be processed in April and if this I140 gets cleared before that, I can get my h1 extension for 3 years.

My priority date is August 2004 EB-3-India.
In USCIS Website, my 485 case status and Ead status got updated dated september 4 2010.
What does this mean by anyway with respect to mygreencard process.Plz help.

Hi,
I am currently on H1b and have accepted an offer for another position which was not advertised. Now, the non-profit will sponsor my h1b. I am wondering if they will have to advertise the position and file a new labor, etc or not.

I had already gotten my USDOS approval and my USCIS approval for my J waiver. The whole process took less than a month which surprised us! But it was stated on the I-797 that I should start working for my employer within 90days from March 19, which will be June 19. The problem is my training program does not end until June 30. Even if I wait until June 19 to file for my H1B, and if I don't go for premium processing, once they approve it and retro-date it, there will be an overlap from June 19-30. Can I apply for the H1 on June 30 instead (when my J expires) but that will be more than 90 days from March 19? I will appreciate any suggestions. Thanks!

Hello,
I filed 485 and also obtained EAD and AP. My wife has her own H1b through her employer, but used the AP from my 485 application once to enter the U.S., so right now her I94 shows an �AOS� status without an expiration date. Now her employer just filed H1b extension for her and the case is still pending.
My question is:
1) Can she travel internationally while her H1b extension case is pending and come back using AP? I was told this could void her H1b extension application according to the �last action rule�, is that true?
2) If 1) will be a problem, could it help if she stays aboard until her H1b extension gets approved and have the document mailed to her before she comes back?

As long as your company is generating Paystubs you are not outofstatus. but if there is an audit and if INS finds that you have not paid then its will be an problem.

But when Republicans shut down the government in a spending clash with President Bill Clinton, Mr. Gillespie warned it was the wrong battle to pick.
�He understands the limits of what you can expect people to buy,� Mr. Armey explained.
Now, after a stint as Republican National Committee chairman and a lobbying career that made him a multimillionaire, Mr. Gillespie is back in government as a street fighter and salesman for conservative ideas and the politician behind them � in this case, President Bush. Once again, he is in the thick of a budget fight between the White House and Congress.
But this time, he is driving the confrontation.
As the clock ticks toward a Congressional recess, with Democrats struggling to wrap 11 major spending bills into one and Mr. Bush threatening to veto the huge package, Republicans see the hand of Mr. Gillespie at work. As counselor to the president, a job he took in July, Mr. Gillespie is trying to write a new narrative for Mr. Bush, one that casts him in the role of fiscal conservative, sharpening the contrast between him and Democrats while repairing his tattered image with the Republican base.
On Mr. Gillespie�s watch, the president�s speeches have grown shorter, his language punchier. When Mr. Bush threatens to veto a �three-bill pileup� or likens Congress to �a teenager with a new credit card,� Gillespie-watchers all over Washington say they can hear the new counselor�s voice.
�Ed believes that one of the reasons the Republicans lost is because we had lost our way on spending,� said Pete Wehner, a former policy analyst for Mr. Bush who left the White House this spring. �He worked for Dick Armey; I think he�s a small government conservative, and I think he believes Democrats and their spending habits are a target-rich environment.�
And Democrats have provided targets, by waiting until two months into the new fiscal year to finish their appropriations work. Mr. Bush has already vetoed Democratic measures on children�s health and Iraq war spending, and a water resources bill � all the while complaining lawmakers are wasting taxpayers� money, and scolding them like errant schoolchildren who forgot to turn in their homework.
�Listening to this, it has Ed Gillespie�s fingerprints on it,� said John Feehery, a Republican strategist. �It�s shaping the message to pick the right fights � with a smile.�

At 46, Mr. Gillespie is part of a core of newcomers who are seeing Mr. Bush through the end of his presidency as his Texas inner circle breaks up. Unlike his predecessor, Dan Bartlett, who spent his entire adult life working for Mr. Bush, Mr. Gillespie not a presidential intimate, but neither is he a stranger.
In 2000, he was a member of the Gang of Six, a group of strategists for the Bush-Cheney campaign. That same year, he joined with Jack Quinn, a former White House counsel to Mr. Clinton, to found Quinn Gillespie & Associates, his lobbying firm. He earned a reported $4.75 million when he sold his share of the firm to join the White House, but he could easily pass through Washington�s revolving door yet again, earning even more after Mr. Bush leaves office.

* AILA has reported that during the period of July, August, and September 2007, Nebraska Service Center and Texas Service Center adjudicated 60,000 plus EB-485 applications. Since EB visa number was unavailable for the entire EB cases in August, presumedly a substantial portion of these cases could include those cases for which the EB visa numbers were pull out before July 2, 2007 in June and adjudicated throughout the period as reported by some I-485 applicants who reported that their I-485 applications were approved when the visa number was unavailable. Interesting.

The Diversity Immigrant Visa program is a United States congressionally-mandated lottery program for receiving a United States Permanent Resident Card. It is also known as the Green Card Lottery. The lottery is administered on an annual basis by the Department of State and conducted under the terms of Section 203(c) of the Immigration and Nationality Act (INA). Section 131 of the Immigration Act of 1990 (Pub. L. 101-649) amended INA 203 to provide for a new class of immigrants known as "diversity immigrants" (DV immigrants). Here's my experience. I only have original receipt notice for H1 extension. Local offices in Jersey City and Bayonne wouldn't renew driving license. I went to Trenton. There the supervisor's name is Jewel. She checked their TVR book and that says H1 extension receipt notice is enough for 8 months renewal. She helped me with that and said she would tell their bosses about the local offices.

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.I also heard same thing but talking to a attorney is good than posting here..

It also states that I need to be with the company for 6 months from the time green card is approved. In case I leave the company prior to 6 months for whatsoever reason, I need to pay $15000 as damaging charges to company.
He says that signing this memorandum is mandatory otherwise he will not file I-140.
My questions is , Is it legal to bind an employee to these conditions and ask processing fee to file Green card ? Also are these documents valid from legal perspective ?
