Hi,
My husband was had complete his MS from US and moved to H1 , recently went to India for and his H1 visa is rejected. I am on L1 so now he got his L2 visa approved.
I wish to know the following -
In order to start working as soon as possible what all options he has.
I long will L2 EAD will take?
Can he switch back to is orginal H1 once he come back to US? or he has to apply new H1.
Can he apply for both H1 and EAD. If so which one will be taken in to consideration if both are approved?
Please give you expert advice on what to do next.
Thanks

Readers have been sending me the best links. Here's one from the latest issue of Newsweek: As the white house revives immigration reforman issue the president is discussing with congressional leadersit may want to ponder the effects of curbing foreign labor. While immigrants are blamed for dragging down American wages and stealing jobs, University of California, Davis, economist Giovanni Peri comes to a different conclusion. In a National Bureau of Economic Research working paper, Peri trowels through nearly five decades of immigration data and finds that foreign workers have boosted the economy, jacking up average income without crowding out American...

[UPDATE: You can see the FOIA'd documents here.] The AP's Suzanne Gamboa has a great article describing how a program billed as voluntary for communties turned out to be impossible to get out of once a city has enrolled. Gamboa has reviewed internal documents sought in a Freedom of Information Act request filed by the Benjamin Cardozo School of Law in New York, the National Day Labor Organizing Network and the Center for Constitutional Rights. ICE has opposed the release of the documents, but a New York judge ordered the information be released. Here are highlights from the AP piece:...

I have an approved I-140 and have a pending I-485 filed with NSC, received date 15 Aug 07. NSC I-485 processing date was moved up to Aug 15 a few days ago.
Was wondering if anyone else with similar received dates got an approval or some form of reply from NSC?

I've received very good advice from IV members and hope to get this one sorted out here. My in-laws passed away within the last 2 years and wife's younger sister is stressed out. To cheer up we plan to bring her to US for 2 months. Her visa may get rejected for these reasons. No strong family ties in India since the parents passed away. She is an engineer (non-IT) but not employed and she is unmarried and no other siblings in India.
However she is a partner is her father's business and can show the documents as a proof.
What's the best way to get apply for visitor visa
1. I sponsor her visit, by sending bank statements, pay slips and employment letters etc.
2. She applies on her own and show her partnership documents, bank statements etc..
3. She goes through a travel agent like SOTC and book 10 day sightseeing trip and after which she could join us.
Obviously her sister being in US and no parents back home is a big red flag but we can't change that situation.
Any advice will be much appreciated.

Hello All,
I will be appearing for L1 individual visa extension in chennai in a few days from now.
One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?
Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.
Please advise as it would help me in responding with correct answer. Thanks.

Hi Pappu and rest of IV admins,
I have been an active donor but had to temporarily cancel my subscription due to pay pal problems. I am back donating again and cannot access the donor forums. Could you please help me with this issue? I tried writing on the 'Contact us' form, but havent had any luck so far.
Could you please send a PM or an email with your latest contribution details. Its better to message us rather than opening a thread.
Thanks

I have my H1 filed in 2008. Due to the market situation, I didn't go for H1 stamping and entered US in March 2009 on H4.
I would like to know the steps/process for H4 -> H1 COS.
I know my employer is the best person to answer this. But, the problem is whenever I ask any details, he always tries to abstract the info.
If there are sequence of steps, after which step one is authorized to work? I tried getting the info online, but couldn't . If any of you can give me a pointer or explain the process in detail, it would be very great and helpful.
As per my employer, I can start working in 2 weeks after he initiates the process. I want to make sure that I don't run into any legal issues. Once the employer has initiated the COS process, is there a way one can track the status and also to verify the status after the completion of the process.
Sorry for too many questions. But, please please do help!!!
Thanks a ton in advance!!

If you are working on H1 then dont renew your AP, you can always travel and enter using your H1. If you plan to use your EAD pretty soon (or your H1 is expiring soon and you dont plan to renew it ) then apply 60 days before you plan to start using EAD and you should be fine.
You can even apply for AP after the current one has expired, its just that you wont be able to travel till you get your new AP if you have abandoned your H1 status.

Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

It has now been nearly two years since the Senate voted to kill an immigration reform package and the hopes of ever dealing with the mess that is our immigration system seemed over for the foreseeable future. But a lot has changed in 23 months. Most importantly, there was an election in 2008 that dramatically changed the politics on the issue. There are ten more Democrats in the Senate and nearly 30 more in the House. And there is a Democratic President that likely owes his win to Hispanic voters turning out in large numbers to deliver several states that...

My aunt (fathers sister) is separated (not divorced) from her husband for over 17 years now. She and her 24 year old son (who was 7 years old when his parents separated) live with our family for last 17 years. Her application for visitor visa was rejected in year 2003 when I had invited her to attend my graduation ceremony. At that time I had not sent a sponsor letter. I have invited her to visit me again and this time I am sponsoring for her visit. She owns a house in India and her son owns a business.
Would her marital status (separated but not divorced) create any issues during the interview?

Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. The annual migration of illegally present immigrants has dropped from about 850,000 a year a few years ago to just 300,000 a year today. Why? Probably a combination of a lousy economy and much more vigorous enforcement, particularly at the border. Here is the report for your viewing pleasure: pew hispanic study 08-2010 -
