Hi,
I have a question about H1B transfer. I joined a company A on h1b in may 2005 and did an H1B transfer on july 2006 to company B. Now INS has sent an RFE (for company B financial). I have submitted all the relevant documents when I joined company B for H1B transfer so my credentials are crystal clear. Now when the comhpany B sends a response to INS and if H1B does not get approved. Would I be able to do an H1B transfer to any other company. I spoke to one company they are saying that since the RFE is on the company's credibility so they can do an transfer provided if we submit all the paystubs which we got from company B. I have been working for a client and have all the recent paystubs. Please advice.

Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

Hello!
I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:
Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.

In Mid 2007, 7th year of H-1B tansfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsor�s (ex-employer) company was closed at the end of 2007.
The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.
I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided �An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B�. we just realized that a memo was posted regarding this on 05/30/2008.
As I don�t have this evidence... Please advise or recommend me...

It is safe to apply for N-400 after 90 days prior to 5 years and your wife can wait and apply in another couple of months.

Need your help. Can I ask my employer to file a new perm labor processing while I am on EAD status (pending my existing case)?
Idea is to do EB3- EB2 porting with a perm. I heard you can file Perm only if you are on H1 or other status and not on EAD (AOS Pending I485).

1. If we withdraw I485, can I apply for B1 visa later to come back for business? Or because we have applied for immigration visa, our B1 application will be denied?
2. If we change I485 to Consular Process, probably we can not apply for B1, right?

I've been visiting forums for the past 2 weeks since my petition at CSC is pending under Premium Processing. I don't think this is accurate especially for I-129 pending at CSC, VSC as I see in the forums that for several people its taking more than 2 months for regular H-1B.
IN my case, I filed under PP at CSC on 25th May. They received via fedex on 27th May, but they issued me a receipt on 6th June only. Going at all the forums, it appears its happening with everyone. Then they issue a RFE on the 14th day of the receipt.

Filed July 1st 2007 and my I-485 was transferred from NSC->CSC->NSC. Have a I-485 receipt # that starts with WAC, but is currently pending at NSC. Any recent WAC# approvals?
Tried opening a SR - the SR# ends with CSC. I don't think it will help as SR was directed to wrong Service Center.
In addition to all USCIS inefficiencies, this transfer between service centers makes my case all the more confusing and even more unlikely to be approved anytime soon. Very frustrating!!

I am on a H1B with company A. I've been offered a job with company B which is currently processing my H1 transfer paperwork. I had accepted the offer letter from company B and had submitted all my papers for H1B transfer.
The starting date in the company B is 20th Nov as per offer letter. Now I had decided to stay back with the company A (by 18th Nov) before joining the company B. Is there any issue by doing so?
